Welcome to SeaBuddy Classic Boats For Sale ("SeaBuddy", "we", "us", "our"). By accessing or using our website at seabuddyclassicboatforsale.com or any associated services, you agree to be bound by these Terms of Use. If you do not agree, please discontinue use immediately.

1. Acceptance of Terms

These Terms form a legally binding agreement between you and SeaBuddy. They apply to all visitors, registered users, sellers, brokers, and any other party who accesses or uses the platform. We may revise these Terms at any time; the revised version becomes effective when published. Registered users will be notified of material changes by email at least 14 days in advance.

2. Accounts and User Roles

SeaBuddy supports three account roles:

• Buyer — can browse listings, save favourites, and contact sellers or brokers. No listing privileges.
• Seller — a private individual with permission to list vessels they own personally, subject to plan limits and editorial review.
• Broker — a professional or business entity with permission to list vessels on behalf of owners under a professional brokerage arrangement.

You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must provide accurate information at registration and keep it current. Accounts are non-transferable.

3. Listing Rules and Editorial Approval

All vessel listings submitted to SeaBuddy are subject to editorial review before publication. We reserve the right to approve, reject, edit, or remove any listing at our sole discretion, including but not limited to listings that contain inaccurate specifications, misleading pricing, prohibited vessels, or poor quality imagery.

You represent and warrant that you have full legal authority to list the vessel, that all information provided is accurate to the best of your knowledge, and that you will promptly update or remove a listing once a vessel has been sold or withdrawn from sale.

4. Prohibited Conduct

You agree not to:

• Post false, misleading, or fraudulent listings or communications.
• Impersonate another person, business, or brand.
• Scrape, harvest, or systematically extract data from the platform without written consent.
• Interfere with or attempt to disrupt the integrity or performance of the platform.
• Circumvent any access controls, authentication, or subscription paywalls.
• Use the platform to send unsolicited commercial communications ("spam") to other users.
• List stolen, encumbered, or legally disputed vessels without disclosure.

5. Fees and Subscriptions

Certain features of SeaBuddy require a paid subscription or a per-listing fee. Current pricing is displayed on the Sell page. All fees are stated inclusive of applicable taxes where required by law. Payments are non-refundable unless a listing is rejected by our editors before publication, in which case a full refund will be issued automatically.

We reserve the right to modify fees at any time. Existing paid subscriptions will not be affected until their renewal date, at which point the new rates will apply.

6. Marketplace Disclaimer

SeaBuddy is a marketplace platform. We are not a party to any transaction between a buyer and a seller or broker. We do not own, inspect, survey, title-check, or insure any vessel listed on the platform. Any sale or purchase is a private arrangement between the parties involved, and SeaBuddy bears no responsibility for the condition, legality, or value of any vessel.

Buyers are strongly encouraged to commission an independent survey and conduct appropriate due diligence before committing to any purchase. SeaBuddy does not verify ownership titles, lien status, or registration documents unless explicitly stated on a specific listing.

7. Limitation of Liability

To the fullest extent permitted by applicable law, SeaBuddy and its officers, directors, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, including but not limited to loss of revenue, data, goodwill, or vessel value.

Our total liability for any claim arising out of or relating to these Terms or your use of the platform will not exceed the total fees paid by you to SeaBuddy in the 12 months preceding the claim.

8. Termination

We may suspend or terminate your account at any time if we determine, in our reasonable judgment, that you have violated these Terms or that your conduct poses a risk to other users, to SeaBuddy, or to third parties. You may close your account at any time through your account settings or by contacting us directly.

Upon termination, your active listings will be removed and your access to paid features will cease. Provisions of these Terms that by their nature should survive termination — including disclaimers, limitations of liability, and governing law — will continue to apply.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory consumer protection laws in your country of residence provide otherwise.
